Speeding is a hugely contentious issue that affects hundreds of thousands of us every year and in many cases, it proved to be nothing more than revenue enhancement, a way of supporting the state/local budget without raising taxes. One of the continual problems under motor cover is the loss of no claims discount when a company pays out in circumstances in which one driver considers himself/herself to be innocent. Policyholders are obliged by their policies to notify insurers of an accident. They are not obliged, however, to make a claim. It is important that insurers make it absolutely clear to policy holders that they have this option when no damage to the other party has occurred. The ombudsman declared his intentions in 1982 to explore the feasibility of seeing if insurers could make it clear to policy holders that the option was theirs. Once the insured has put the claim into the insurer’s hand, he cannot then dictate how the third party claim should be handled.

 

Another area of concern involves third parties who agree to pay the damages themselves but renege when presented with the bill. The ombudsman suggests that a partial cure would be to adopt what exists in some countries, namely, a register of insurance cover that would assist the claimant in locating the other parties’ insurers. To date, no such central register exists in the UK.

 

Where two drivers are insured with the same company, the apportionment of blame and the resulting effect on no claims discount is often an area of contention. The claims manager may decide that both are to blame and thus both parties may lose their discounts. The problem was described by the ombudsman as an undesirable state of affairs. It is difficult to see a solution. In one particular case, counsel’s opinion was sought which had the effect of contradicting the claims manager’s assessment of liability. It would clearly become a drain in the Bureau’s resources if counsel’s opinion was sought on too many occasions. What is important is that insurers are aware of the conflict in such cases, and give the matter special consideration rather than treat it as purely an internal claim matter.

 

‘Knock for Knock’ agreements are the clause of numerous complaints by motorists. These are intended largely as accounting procedures between insurers in an effort to keep down administrative costs. Unfortunately, it would appear that such companies will often accept at face value the counter accusations of blame made by each policyholder, and thus deduct from the no claims discount. The Ombudsman accepted that this often happened, and called upon insurance companies to guard against the unfair implementation of these arrangements in cases where one party could show that he was blameless. Insurers should remember that they should defend the insured’s rights, not simply accepting blame because it might be administratively easier for them to do so. There is little point in asking witnesses if their views are not to be taken seriously. In recent years, knock for knock agreements between insurers have been abolished on the grounds that they did not lead to administrative cost savings as they once did.

 

Car insurance policies, indeed all motor insurance policies usually require that vehicles be kept in roadworthy condition. A problem may then arise when the insured chooses to do his own repairs. If a subsequent crash can be traced to faulty home servicing, then insurers are right to reject the claim. The ombudsman suggested that where an expensive or special car is insured, it might be worth considering a ‘special’ policy endorsement calling for professional servicing to be undertaken.

 

The value of a ‘write-off’ is often another area of contention. The Ombudsman appreciated that offers, rejections and new offers might occur when the claim was against a third party insurer because, as he explained, this is the realm of contentious business. Where, however, it was a claim of one’s own insurer, the offer should not be one intended for further negotiation. It should be a genuine offer based on the best evidence available. That evidence has now been declared by the Ombudsman to be the cost to the insured of purchasing a car of similar quality on the open market.

 

An area of great misunderstanding in motor insurance is the scope of the cover to drive. Two specific problems arise. When other named drivers appear on the certificate of insurance, this does not give them cover to drive other vehicles, unless that other vehicle is insured for that driver. The misunderstanding arises because the certificate does give the policyholder, but not the other driver, the cover to drive another vehicle. But that leads to the second problem. The extension to drive another vehicle does not usually give comprehensive cover to the second vehicle, but only the basic requirements of the Road Traffic Act 1988, namely, cover against third party liability. The Ombudsman makes no criticism against insurers for this, it is merely apart of motor insurance law. He does suggest, however, that it might be worthwhile for certificates to reflect this all important point in clearly expressed language.

By incorporating a LLP, its member can avail the benefit of limited liability and the flexibility of organizing their internal management on the basis of a mutually-arrived agreement, as is the case in a partnership firm.

This format would be quite useful for small and medium enterprises in general and for the enterprises in services sector in particular, including professionals and knowledge based enterprises.

A revised LLP Bill was introduced in the Rajya Sabha on 21st Oct. 2008. The Bill was passed in the Rajya Sabha on 12th December, 2008. The Bill received assent of Hon’ble President on 7th January, 2009.

The LLP Rules 2009 covering the registration and other operational aspects of the Act have been notified in the official gazette on Ist April 2009

The silent features of Limited Liability Partnership Act 2008 are as under:

1) LLP is governed by the Limited Liability Partnership Act 2008, which has come into force with effect from April 1, 2009.

2) A LLP is a body corporate and a legal entity separate from its partners having perpetual succession. While the LLP is a separate legal entity, liable to the full extent of its assets, the liability of the partners would be limited to their agreed contribution in the LLP;

3) LLP combines the advantages of running a Partnership firm, and separate legal entity status & limited liability aspect of a Company;

4) A LLP is a separate legal entity and separate from its partners. It can own it’s assets, sue and be sued;

5) The members of LLP have the right to manage their business directly, which facility is not available to corporate shareholders;

6) To constitute an LLP minimum of 2 partners is required. The Act has not prescribed ant maximum no. of members;

7) The mutual rights and duties of partners of an LLP inter se and those of the LLP and its partners shall be governed by an agreement between partners or between the LLP and the partners subject to the provisions of the LLP Act 2008.  The act provides flexibility to devise the agreement as per their choice.  In the absence of any such agreement, the mutual rights and duties shall be governed by the provisions of proposed the LLP Act;

8) The LLP shall be under an obligation to maintain annual accounts reflecting true and fair view of its affairs.  A statement of accounts and solvency shall be filed by every LLP with the Registrar of Companies (ROC) every year;

9) The Indian Partnership Act, 1932 is not being applicable to LLP.

10) No partner would be liable on account of the independent or unauthorized actions of other partners, thus allowing individual partners to be shielded from joint liability created by another partner’s wrongful business decisions or misconduct.

A LLP is advantageous because of it’s comparatively lower cost of formation and running, lesser compliance requirements, easy to manage and run and also easy to wind-up and dissolve, no requirement of minimum capital contributions, partners are not liable for the acts of the other partners and importantly no minimum alternate tax (as of date). But, LLP cannot raise money from the public.

LLP should maintain annual accounts. However, audit of the accounts is required only if the contribution exceeds Rs. 25 lakhs or annual turnover exceeds Rs.40 lakhs.

Liability of the partners is limited to the extent of his contribution in the LLP. No exposure of personal assets of the partner, except in cases of fraud.

The Registrar of Companies (ROC) is the authority having jurisdiction over the incorporation. The steps required to incorporate a LLP are as follows::

  1. Decide the Partners and the Designated Partners;
  2. Obtain Designated Partner Identification Number (DPIN) and a digital signature certificate;
  3. Decide on the name of the LLP and check it’s availability with the ROC;
  4. Draft the LLP agreement;
  5. File the LLP Agreement, incorporation documents and obtain the Certificate of Incorporation;

In Canada the regulation of businesses such as nude dancing, escorts, and massage parlours are left up to the municipalities, in accordance with provincial law. Operating licences are given to certain groups and others are dealt with by handing out fines to some extent, and those usually go to the poorest segment of the trade. The hefty licensing fees are not something everyone can afford but they still exist; officially escort services and massage parlours are not part of the sex trade. Escorts provide companionship and massage rooms provide massage. Strippers are not usually prostitutes since their incomes are astronomical. There is no effective effort to re-train strippers or rehabilitate prostitutes due to the large amounts of money available from gentleman customers.

Adapting to modern life requires some evolved morality to see past mere prejudice or indignation and consider the e wider effect of regulating the sex trade equally. Some escort agencies pay a license fee, some don’t. They are categorized separately from body-rub parlours, who pay over $6500 each year to operate; the body-rub parlour is defined as a place where the activities include the kneading, manipulation, rubbing, massaging, touching, or stimulating, by an means, of a person’s body or part thereof but does not include medical or therapeutic treatment given by a person otherwise duly qualified, licensed or registered to do so under the law. The body-rub license in Vancouver is $6,527 a year, the third largest fee after the racetrack and the Pacific National Exhibition. In contrast the escort service license is only $802.

Each city normally licenses and regulates all the escort agencies and strip clubs but only a fraction of the more numerous body-rub parlours are inspected, licensed, or regulated because of the fee required to identify them as such, and the license fees required for all the workers. The police don’t spend time and resources on sting operations, it’s very much a live-and-let-live arrangement as long as discretion is used and zoning regulations aren’t broken. If they don’t bother the neighbors then it’s business as usual. Like most people in Canada, the police no longer feel that they should be enforcing a moral code on consenting adults. The women who suffer most are working on the city streets; they don’t have a place to go and they are often victims who need help rather than criminal prosecution for soliciting.

Dating services are treated as totally different entities, even though they are in essentially the same business of getting people together for companionship and sex; they just don’t provide the premises for encounters. They are licensed at around $100 a year and must record the names of their customers, unlike the discreet necessities of the massage and escort sector. The law gives a bigger break to the escorts than the taxpaying dating service. Escort agencies that arrange for prostitutes to meet clients violate the laws against “procuring” – including the “pimping” offence of living on the avails of prostitution. If you take the law literally even the Yellow Pages and other advertising forums could be said to violate procuring laws when they carry ads for prostitution services, particularly when advertisers recruit new staff. There is one big flea in the ointment however: escort agencies spend enormous sums to advertise. There are many companies that rely on the hundreds of thousands of dollars brought in every year from the full-page ad campaigns of the cash-rich escort sector. In the current economic state of things, any money circulating has to be encouraged, including the collection of taxes from areas of the sex trade carried on in cash – basically the entire industry.

Rear cylinder head gasket defect leading to engine failure, burning engine oil, engine stalls and overheats. Models influenced 2007 to 2008 FLHRSE3, FLHTCUSE2, FXDSE, FXSTSSE, FLHRSE4, FLHTCUSE3, FXDSE2 and FXSTSSE2.

Defective front brake and fender not adequately retained and may become dislodged while driving. Models affected 2008 FXSTSSE2, 2009 FXSTSSE3 and 2008 to 2009 FLSTSB.

Defective braided clutch cable contact with rear brake line leading to loss of fluid and brake failure. Models affected 1984 to 1999 FXR, 1991 to 1998 FXD and 1984 to 1999 FXST.

Defective blade rear wheel cracks from factory heat treatment process that could result in wheel failure. Models influenced 2009 FLTRSE3.

Electric fire due to defective positive battery wire contact with oil tank. Models affected all 2007 FatBoy motorcycles FLSTF.

This alleged defect appears to affect over 11,000 models and Harley Davidson and Screamin’ Eagle motorbikes.

The bike will start to oscillate forwards and backwards and it’ll literally store energy like a spring. So, with each oscillation forwards and backwards, it is getting worse and it is a terribly short period of time before someone can be thrown off the motorcycle.

This can happen even to a professional rider and happens very swiftly. Everything goes from perfectly normal to very abnormal in the blinking of an eye. It is a sensation for which the rider is not very likely to have any experience, it’s a feeling that does not make sense to the rider and could cause heavy injuries to the driver and passenger.

Need to get OSHA certification, but not sure of where to start? As of recent, more states are requiring OSHA training for the construction industry. So how do you know what course you need?

The most commonly requested OSHA course is OSHA 10-hour Outreach Training for the Construction Industry. This is because it is state-mandated. If you are completing construction public work projects in the following 7 states you will have to get your OSHA 10 hour Outreach card:

* Connecticut
* Massachusetts
* Missouri
* Nevada
* New Hampshire
* New York
* Rhode Island

In addition to these state, enrollments have been increasing for other states whose work or contract requires OSHA training, or there has been a safety and health program adopted. States that have seen a recent increase in OSHA 10-hour Construction Course graduates are California, Ohio, Florida, Georgia, New Jersey and Texas.

The OSHA 10-hour construction course covers the necessities of OSHA regulatory standards including Fall Protection, Personal Protective Equipment, Material Handling and more.

Generally, most workers need either the 10 or 30 hour Outreach card. The 30 hour course gives a more comprehensive view of the OSHA regulations and hazard identification, and includes additional lessons such as OSHA Standards and Inspection Procedures, Recordkeeping, Fire Prevention and more.

Even if you are not required by law, it may be required by your employer or for a future project. Regardless, having an OSHA card is considered an asset and would look good on your resume.

The other main type of OSHA training is the OSHA trainer certification courses. Completion of the trainer courses allows you to teach 10 or 30 hour outreach training. For construction, this is the 500 Trainer course. To qualify, you need to have five years of construction safety experience and have completed the 510 Occupational Safety and Health Standards for the Construction Industry course. This course covers the OSHA construction regulations in detail.

So how do you find the training? You can take a classroom course provided by a trainer in your area, as well as enroll in a course provided by OSHA Training Institute Education Centers across the nation. However, online training is more accessible and the best option for those not able to attend a live classroom course. More people are choosing online training to cut travel costs, time off work and because live classroom courses for the required states fill up quickly.

To start, do an online search for either OSHA 10 hour, 30 hour or 510 certification course. Make sure you find a provider that offers OSHA accepted courses. Generally the website will say OSHA accepted, authorized or accredited. USF OSHA offers OSHA accepted 100% online training that is usually lower in price than the live versions. And you can also find coupons online.

Last, remember to call the training provider’s number listed on the website for bulk discounts. If you have multiple sign-ups for your company this can save quite a bit of money. If you’ve registered for the online course, you will generally have 6 months to complete. There is a course trainer available to you for any questions you may have. At the end of the course is a final exam which you have to pass with an 70 or higher in order to get your certificate.

After you complete your training, your OSHA card and/or certificate should be delivered within 10 business days. You may be able to get it sooner if you request and expedite from the provider.
